EU Updated EuP Directive to ErP Directive

On 21 October 2009, the European Council (EC) adopted a revision of the EuP Directive (hereinafter called "ErP Directive"). Modifications were made to the Directive in order to extend its scope. As a result, the Directive will now focus not only on ¡§energy-using products¡¨ but will be extended to include all ¡§energy-related products¡¨, such as windows, water taps, shower heads, etc. Besides a wider scope, there is not much difference between these two directives.

Modifications of the Energy-using Products (EuP) Directive

The new Ecodesign Directive 2009/125/EC adopted by the EC is repealing EuP Directive 2005/32/EC and entering into force on 20 November 2009. Its scope is now not only targeting energy-using products but also all energy-related products, defined as goods ¡¥having an impact on energy consumption during their use¡¦ such as insulation materials, windows, shower heads or taps. However, the new Directive still does not apply to transportation of persons or goods.

The change of scope will lead to the definition of new categories of priority products and to the launch of new preparatory studies. A working plan will thus be defined by the EC, while the current working plan focusing on EuP¡¦s and adopted on 21 October 2008 for 2009-2011 is still in application for the time being.

The elaboration process of new implementing measures for energy-related products will be the same as for energy-using products, from the realization of preparatory studies to the publication of the final EC regulations, after approval of draft Implementing Measures by the Regulatory Committee.

The integration of ecodesign practices in the design process of an energy-related product and the consideration of its whole life cycle shall lead to significant potentials for improvement, thus achieving energy and resource efficiency of a much wider range of products, which can also lead to economic savings for businesses.

Applicable Requirements

As per Directive 2005/32/EC, products must comply with Directive 2009/125/EC once they are targeted by specific Implementing Measures. In that case, the conformity assessment will be specified in the Implementing Measure and shall leave the choice between the internal design control and the management system set out respectively in Annex IV and Annex V of the ecodesign Directive.

Products in the scope of a regulation implementing the ecodesign Directive placed on the market before 20 November 2009 need to comply with Directive 2005/32/EC. If these products are placed on the market after 20 November 2009, they need to comply with Directive 2009/125/EC. All references to the repealed Directive must be construed to Directive 2009/125/EC.
